Great news: we have a November 2017 update Corporation tax. Thankfully the tax authorities are reacting to the mess they’ve created on theCorporation tax and form D140. I can assure you, it is driving me nuts. The bureaucrats at the Costa Rican tax office have a hard time making the right decisions.
Of course, the new law should not have been approved the way it was and now the tax office is totally swamped. But, this time, we have some good news for most of you.
Temporary suspension
Today, on November 6, 2017, the Costa Rican tax office sent out declaration Nº DGT-R-51-2017. This declaration states that the obligation to fill out declaration and modification of data form D140 for an inactive corporation is suspended starting today.
But we’re not done yet. There is even better news in this November 2017 update Corporation tax.
Dissolved corporations
Those corporations that are dissolved by the government and have canceled pending corporation taxes 2012 – 2015 before December 15, 2017, can present a request to cease its dissolution to the National Registry.
This request will leave the dissolved corporations in the same condition as they were before the dissolution with retroactive effect.
Corporation owners have until January 15th, 2018 to make the request before the National Registry, after having paid the pending taxes.
Non Payment
This November 2017 Update Corporation tax does not mean you can now stop paying. The tax authorities still want your money, on the dates stipulated in the other articles. Don’t forget to pay 2018.
When to file now?
Those who had planned to file their D140 to modify the data of their inactive corporation can stop doing it. Your form will not be accepted by the tax office right now. These are the new dates:
a) Corporate ID ending in 1 and 2: During the month of February 2018. (this is only for those corporations that were registered in the National registry before October 31st, 2017 or those that were dissolved.
